Welcome to the Nissan Car Club Australia (the "Club"). By signing up for membership, purchasing from our online store, or participating in Club events, you agree to comply with and be bound by the following Terms and Conditions.

1. Membership and Eligibility

  • Acceptance: Membership is subject to approval by the Club Committee. We reserve the right to refuse membership to any applicant at our discretion.

  • Fees: Membership fees are payable annually. Failure to pay fees by the due date may result in the suspension or termination of your membership.

  • Personal Use: Membership benefits are for the individual member and are non-transferable.

2. Member Code of Conduct

To ensure a safe and enjoyable environment for all enthusiasts, members must adhere to the following Code of Conduct. Failure to comply may result in immediate termination of membership.

  • Safe Driving: Members must operate their vehicles in accordance with all Australian road rules and laws. Dangerous driving at Club events or on public roads while representing the Club is strictly prohibited.

  • Respectful Behaviour: Harassment, bullying, or discrimination of any kind towards other members, Club officials, or the general public will not be tolerated. This extends to online forums and social media groups managed by the Club.

  • Vehicle Condition: Members are responsible for ensuring their vehicles are roadworthy and registered (unless the event is on a closed circuit where specific track rules apply).

  • Brand Representation: Members must not act in a way that brings the Club into disrepute.

3. Online Store Terms of Use

The following terms apply to all purchases of merchandise, parts, or accessories made through the Nissan Car Club Australia website.

  • Product Availability: All products are subject to availability. We reserve the right to limit the quantity of products we supply or to discontinue any product at any time.

  • Pricing: Prices are in Australian Dollars (AUD) and include GST unless otherwise stated. Prices are subject to change without notice.

  • Accuracy: We make every effort to display the colours and images of our products accurately. However, we cannot guarantee that your computer monitor's display of any colour will be accurate.

  • Shipping: Risk of loss and title for items purchased pass to you upon our delivery of the items to the carrier (e.g., Australia Post).

4. Refund and Returns Policy

A. Membership Fees

  • No Refunds: Membership fees are strictly non-refundable. Once a membership fee has been paid, no refunds will be issued for "change of mind," inability to attend events, or early termination of membership by the member.

B. Online Store Purchases

  • Change of Mind: We do not offer refunds or exchanges if you simply change your mind or choose the wrong size/part. Please review your order carefully before purchasing.

  • Australian Consumer Law: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

5. Limitation of Liability

  • Participation at Own Risk: Participation in Club events, drives, and track days is entirely at your own risk. The Nissan Car Club Australia, its committee, and its volunteers are not liable for any injury, death, or property damage resulting from participation in events.

  • Indemnity: You agree to indemnify and hold harmless the Club from any claim or demand, including legal fees, made by any third party due to your breach of these Terms.

6. Changes to Terms

The Club reserves the right to update, change, or replace any part of these Terms and Conditions by posting updates to our website. It is your responsibility to check this page periodically for changes.
